Code 7133 applies to the operation of railroads, including subways. Code 7133 is not applicable to street railroads or railroads subject to the Federal Employers' Liability Act. The determination of whether a railroad operation is covered under a state act or the Federal Employers' Liability Act is not made by NCCI as NCCI does not provide legal opinions relating to questions of coverage. Street railroads are given the same classification treatment as bus companies, i.e., yard employees are assigned to Code 8385, the classification applicable to garage employees of bus companies, and Code 7382 is assigned to all other employees, which would include operators or drivers, conductors, etc.
